Affiliate Program Terms and Conditions – OunTravela Publishing<\/h1>\n

Introduction<\/b> The OunTravela Publishing affiliate program (ountravela.com) is managed via the Partnero platform by “Explore Media”, a French company whose legal representative is Ms Olivia CASARI, registered under SIREN number: 897431763. By participating in the OunTravela Publishing Affiliate Program, you (hereinafter referred to as the “Affiliate”) accept without reservation the Terms and Conditions set forth in this document.<\/p>\n

Article 1: Acceptance and Eligibility for the Program<\/h3>\n
    \n
  1. Acceptance:<\/b> By registering for the Program and using the resources provided, you agree to be legally bound by these Terms. If you do not agree, you should not participate in this program.<\/li>\n
  2. Eligibility:<\/b> To participate, you must submit an application form and receive formal approval from Explore Media, which reserves the right to accept or reject any application at its sole discretion.<\/li>\n
  3. Independence:<\/b> The Affiliate acts as an independent partner. This contract in no way creates a subordinate relationship or an employer\/employee relationship.<\/li>\n<\/ol>\n

    Article 2: Affiliate Links and Promotional Codes<\/h3>\n

    Upon approval, Explore Media will provide personalized affiliate links and\/or promotional codes (via the Partnero platform). These links and codes must be used to direct customers to Explore Media’s services or products. The Affiliate may not modify or alter these links or codes in any way without prior authorization.<\/p>\n

    Article 3: Fees and payments<\/h3>\n

    Affiliates will receive a commission determined by the percentage in force on sales generated by customers having purchased via their link or code. Commissions are payable in accordance with the specific terms and conditions set out on Partnero and are subject to change at Explore Media’s discretion. In the event of cancellation or refund request by a customer, the corresponding commission will be deducted from the Affiliate’s balance.<\/p>\n

    Article 4: Restrictions and Promotional Ethics<\/h3>\n

    The Affiliate agrees not to use abusive or unethical marketing methods to promote OunTravela Publishing products. The following are strictly prohibited:<\/p>\n

    • \n

      Sending unsolicited e-mails (SPAM).<\/p>\n<\/li>\n

    • \n

      The use of paid advertising (Google Ads, Bing, etc.) by bidding on the brand name “OunTravela”, “Explore Media” or the exact titles of the guides.<\/p>\n<\/li>\n

    • \n

      Promotion on sites containing offensive, illegal or misleading content.<\/p>\n<\/li>\n<\/ul>\n

      Article 5: Intellectual property (strict protection clause)<\/h3>\n
        \n
      1. Exclusive property:<\/b> Explore Media holds all intellectual property rights relating to its products (texts, photographs, maps, GPS tracks, itinerary selection and layout, trail and hike titles).<\/li>\n
      2. Authorized Use:<\/b> The Affiliate may only use the elements provided by Explore Media for the authorized promotion and must not create any confusion as to the ownership of these rights.<\/li>\n
      3. Prohibition on creation of derivative works:<\/b> The Affiliate is strictly forbidden to reproduce, copy, modify or draw inspiration from the Publisher’s products to create its own competitive content. In particular, it is strictly forbidden<\/b> to:\n

        • \n

          Copy or paraphrase descriptions of OunTravela guides and ebooks.<\/p>\n<\/li>\n

        • \n

          Use the structure, layout or a specific selection of tracks and itineraries from Explore Media works.<\/p>\n<\/li>\n

        • \n

          Reuse the same original route titles or GPS tracks for inclusion in an Affiliate’s own product (free or paid).<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n

          Article 6: Duty of loyalty and fight against parasitism<\/h3>\n

          The Affiliate agrees not to use its status as a partner, nor the knowledge it has acquired about Explore Media’s products (sales performance, popular itinerary selections), to follow in the Publisher’s footsteps and develop a competing product (parasitism). Any creation of a guide, travel book, map or ebook by the Affiliate that clearly reproduces Explore Media’s research work will be considered an act of unfair competition.<\/p>\n

          Article 7: Confidentiality<\/h3>\n

          The Affiliate agrees to maintain the strict confidentiality of all information (statistics, strategies, internal documents) provided by Explore Media in connection with this program.<\/p>\n

          Article 8: Termination and penalties<\/h3>\n
            \n
          1. The partnership may be terminated by either party for any reason by written notice.<\/li>\n
          2. Violation of Intellectual Property:<\/b> In the event of violation of articles 4, 5 or 6, Explore Media reserves the right to immediately close the Affiliate’s account, cancel pending commissions and take legal action for infringement and parasitism.<\/li>\n<\/ol>\n

            Article 9: Modification of the Conditions and Limitation of Liability<\/h3>\n

            Explore Media reserves the right to modify these Terms at any time. Changes will take effect immediately upon publication on the OunTravela website or Partnero. Furthermore, Explore Media shall not be liable for any indirect or incidental damages arising from participation in this affiliate program.<\/p>\n

            Article 10: Applicable Law and Jurisdiction<\/h3>\n

            These Terms and Conditions are governed by and construed in accordance with French law. Any dispute or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the French courts.<\/p>\n
